SPANISH INHERITANCE

THE COST
The work done for a Spanish inheritance is charged at a very competitive hourly charging rate of just £65.00 an hour, with no Value Added Tax being charged on top because Mr Wagner is not VAT registered.
However, some items of work referable to a Spanish inheritance are charged at a fixed price, regardless of the amount of time it takes to do the work, although some effort has been made to look at how long it normally takes and charge accordingly at approximately £65.00 an hour, with no VAT being charged on top.
1. Absolutely all Spanish inheritances / probates need to start with getting a certificate from the Spanish Wills Registry. This is regardless of whether you know that the deceased did or did not make a Spanish Will.
If the deceased died in England and there is, therefore, an English death certificate, if you can send to Mr Wagner an original English death certificate, he can translate it into Spanish, certify the translation as being an accurate translation of the original, get both the original English death certificate and the certified translation legalised in accordance with the Hague Convention of 1961, and use both documents to get the essential certificate from the Spanish Wills Registry for the price of £175.00 in professional fees, (with no VAT being charged on top), plus disbursements, (ie the Foreign & Commonwealth Office and Royal Mail), totalling at the time of writing of approximately £65.00.
In short, if you send to Mr Wagner an original English death certificate, plus a cheque for £175.00 + £65.00 = £240.00 payable to Mr E R Wagner, and instructions to get a certificate from the Spanish Wills Registry, he'll get a certificate that will say whether or not the deceased made a Spanish Will.
2. If the deceased died in Spain and there is, therefore, a Spanish death certificate, if you can send to Mr Wagner an original Spanish death certificate, (which looks like a photocopy, but which does have a stamp in blue/purple ink and an original signature on it, in effect, certifying that the photocopy is a true copy of the entries on the register), then Mr Wagner can get a certificate from the Spanish Wills Registry for just £75.00 plus registered / signed for post of around £10.00.
In short, if you send to Mr Wagner an original Spanish death certificate, plus a cheque for £75.00 + £10.00 = £85.00 payable to Mr E R Wagner, plus instructions to get a certificate from the Spanish Wills Registry, he'll get a certificate that will say whether or not the deceased made a Spanish Will.
If you haven't got an original Spanish death certificate, one will have to be obtained if the work of accepting a Spanish inheritance is to be taken to its logical conclusion of having the beneficiaries become the owners of the deceased's Spanish estate. Mr Wagner can get an original Spanish death certificate, but he'll need the full name of the deceased, the full names of the deceased's parents, the full address at which the deceased was habitually resident before he or she died, and, if different, the address of the place at which the deceased died, plus the date of birth and the date of death. The cost is £100.00.
3. If the certificate from the Spanish Wills Registry states that a Spanish Will was made, an authentic copy will need to be obtained so that there is no doubt as to who the beneficiaries are of the Spanish inheritance. The cost is £175.00 in fees for drafting the appropriate form of authority and liaising with the Spanish notary's office in Spain, plus a notarisation fee of £75.00, plus £28.00 payable to the UK's Foreign & Commonwealth Office, plus whatever the Spanish notary charges for issuing an authentic copy Will, (which depends on the length of the document and when it was signed by the deceased, but which, on past experience, usually comes to around £50.00), plus around £12.00 registered / signed for post, ie around £175.00 + £75.00 + £28.00 + £50.00 + £12.00 = £290.00
4. As a matter progresses, it'll be necessary to appoint a Spanish lawyer based in Spain to act on your behalf in the matter of accepting a Spanish inheritance. A Spanish power of attorney will need to be granted. The cost structure is detailed at http://www.spanish-power-of-attorney.co.uk but which for a single person is likely to cost a total of around £233.00.
All work done in addition to the above fixed price items will be charged at the very competitive charging rate of just £65.00 an hour, with no VAT being added on top, but, just to give you an idea of the kind of costs that might be incurred when doing the paperwork referable to a Spanish inheritance, if there is a Spanish Will that can be implemented without any complications arising, the (additional) fees of Mr Wagner are likely to be in the region of just £700.00, with no VAT on top, and the fees of the Spanish lawyer in Spain being around €1,200.00 - €1,500.00, plus VAT, currently 16%, plus disbursements, which will include taxes, and payment of the notary, property registrar, and, very possibly, a professional valuer.
